Legal aid for employment law disputes in the Netherlands

If you are involved in an employment law dispute but cannot afford a lawyer, you may be entitled to subsidised legal assistance (gesubsidieerde rechtsbijstand) through the Legal Aid Board (Raad voor Rechtsbijstand). Legal aid in the Netherlands is available for a wide range of employment law matters: challenging a dismissal, reviewing a settlement agreement, claiming unpaid wages, and disputing a disciplinary measure. Understanding the system allows you to access quality legal advice regardless of your financial situation.

Legal aid is available to individuals - not companies - whose income and assets fall below specific thresholds set annually by the Minister of Justice. For 2026, the income threshold for a single person is approximately €30,500 gross per year; for couples/households, approximately €43,000. Asset thresholds also apply. If you exceed these thresholds, legal aid is not available, but many lawyers offer flexible payment arrangements.


How legal aid works in the Netherlands

If you qualify, the Raad voor Rechtsbijstand issues a toevoeging (legal aid certificate) upon application by you or your lawyer. Your lawyer is then paid by the government at a subsidised rate. You pay only a personal contribution (eigen bijdrage) of currently between approximately €196 and €874, depending on your income. The lawyer handles the matter at the subsidised rate and cannot charge you more than the personal contribution (unless you have specifically agreed a higher rate for additional work).


Applying for legal aid in the Netherlands

You can apply for legal aid online through the Raad voor Rechtsbijstand website, or your employment lawyer can apply on your behalf. The application requires recent income tax data from the Dutch Tax Authority (Belastingdienst). Processing takes approximately one to two weeks. In urgent cases - for example, when a dismissal has just been received and time is of the essence - lawyers can begin work pending the decision. Do not let the legal aid application process delay you from getting advice urgently.

The system of gesubsidieerde rechtsbijstand is administered by the Raad voor Rechtsbijstand under the Wet op de rechtsbijstand. Lawyers who accept legal aid instructions (on the basis of a toevoeging) are paid a subsidised government rate and cannot charge the client more than the applicable personal contribution (eigen bijdrage), which in 2026 ranges from approximately EUR 196 to EUR 874 depending on income. Legal aid is available for employment law matters including dismissal disputes, settlement agreement review, and unpaid wages claims, provided the income and asset thresholds are met.
